This Privacy Policy explains the information that My Level, Inc. collects about users of the Eden mobile application and related website (www.myeden.me) how we use that information, and with whom we share it. By using our website, mobile application or other online services (our “Service”), you are accepting the practices described in this Privacy Policy.

As used in this policy, the terms “Eden,” “us,” “we,” “our,” and “ourselves” refer to My Level, Inc. (“the Company” that created Eden). The terms “you,” “your,” and “yourself” refer to users of our Service.

1. INFORMATION WE COLLECT

Personal Information

In the course of your use of the Service, we may collect individually identifiable information that would allow us to determine the actual identity of, and contact, a specific living person (“Personal Information”). Such Personal Information may include information comments or content that you provide to the Service that may reveal your nationality, religion, ethnic origin, and/or sexual orientation. By providing such Personal Information to us, you consent to the collection, use and disclosure of such Personal Information in accordance with this Privacy Policy and applicable laws.

Voluntary Personal Information

Whenever you voluntarily disclose personal information on publicly-viewable screens or pages, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information. If you wish, we will delete your account information; to do so, please close your account by sending an email to [email protected].

Location

Eden is a location based mobile matchmaking platform that helps you match with people nearby. While the Eden application is in use, we keep track of your location information (e.g. by using the GPS on your mobile device), to provide the functionality of our service. Please keep in mind that other Eden users can see this information about you, and they may use it or disclose it to other individuals or entities outside of our control, and without our knowledge. Your information may be subject to abuse, misuse, or monitoring by others, and you share this information at your own risk. Unless you turn off your location services, we will collect your location information, and by using our service, you consent to our collection, storage, and analysis of your location data.

Technological Collection; Cookies and Device IDs

We use various technologies to collect information from your device and about your activities on our Service. We automatically collect information from your browser or device when you visit our Service. This information could include your IP address, device ID and type, your browser type and language, the operating system used by your device, access times, your mobile device’s geographic location while our application is actively running, and the referring website address. When you access the Service, we may send one or more cookies and small text files containing a string of alphanumeric characters to your computer or device. Eden may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Service. Persistent cookies can be removed. Please review your web browser ‘Help’ file to learn the proper way to modify your cookie settings. Eden does not respond to “Do Not Track” signals. In order to recognize you, store your preferences, and track your use of our application, we may store your mobile device IDs (the unique identifier assigned to a device by the manufacturer) when you use the Eden application. Unlike cookies, device IDs cannot be deleted.

Additional Information

When you use our Service, we receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. Eden may store such information itself or such information may be included in databases owned and maintained by Eden affiliates, agents or service providers. This Service may use such information and pool it with other information to track, for example, the total number of users of our services, or analyzing trends in downloads, invites, or messaging, for instance. Eden may occasionally conduct research on customer demographics by aggregating individual data of our users. Eden may share this non-identifiable and aggregate data with its affiliates, agents, and business partners, but this type of aggregated data does not identify you personally.

2. HOW WE USE YOUR INFORMATION

We use the information we collect in a manner that is consistent with this Privacy Policy. For instance, we use your information to provide the core functionality of our service (help you match with people nearby), to monitor your use of the service and improve the user experience, to respond to your comments and inquiries, to communicate with you regarding the service, and for any other purpose for which the information was provided. When you register as a user of Eden, your Eden profile will be viewable by other users of the Service, unless you specifically enable the “Hide Profile” switch located on the Settings page.

3. USE OF YOUR INFORMATION BY OTHERS

Use of Personal Information

Eden cares deeply about your privacy and without your prior consent, we will not share your Personal Information except as outlined in this Privacy Policy. With that said, there may be circumstances that may lead us to share your Personal Information to a third party without further notice to you. For example, we may share information, including Personal Information, without notice, with third parties that perform certain services on our behalf. These services may include fulfilling orders, providing customer service and marketing assistance, performing business and sales analysis, ad tracking and analytics, member screenings, supporting our Service functionality, and supporting other features offered through our Service. Additionally, we may share your information, including Personal Information, in the event of a corporate sale, merger, reorganization, dissolution or similar event; with our corporate affiliates or subsidiaries for purposes consistent with this Privacy Policy; to enforce our Privacy Policy or other terms of service; and if required to do so by law or when we believe in good faith that such disclosures are required by law; to protect and defend the rights or property of Eden, protect the personal safety of users of the site or the public, or protect against legal liability.

Use of Aggregate or Non-Personal Information

We may use and share non-personal information we collect under any of the above circumstances. We may also share it with third parties to develop and deliver targeted advertising on our Service and on websites or applications of third parties, and to analyze and report on advertising you see. We may combine non-personal information we collect with additional non-personal information collected from other sources. We also may share aggregated, non-personal information, or personal information in hashed, non-human readable form, with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis, advertising, marketing, or other business purposes.

4. CHILDREN’S PRIVACY

We do not allow persons under 18 to register for any service, and we do not knowingly collect any personally identifiable information from persons under the age of 18. If you are under 18 years of age, please do not use our Services and please do not submit any personal information through our Services. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing children under the age of 18 never to use our Services. Please contact us immediately if you have reason to believe that a child under the age of 18 has provided personal information to Eden, and we will make every attempt to delete that information from our databases.

5. INFORMATION FROM USERS OUTSIDE THE UNITED STATES

If you’re outside the United States, your information will be sent to and stored in the United States, where our servers are located. By using Eden, you agree to the information collection, use, and sharing practices described in this Privacy Policy. If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your personal data, including sensitive data, by Eden from your region to countries which do not have data protection laws that provide the same Eden of protection that exists in countries in the European Economic Area, including the United States. By providing your personal information, you consent to any transfer and processing in accordance with this Policy.

6. INFORMATION YOU PROVIDE

We provide areas on our Service where you can post information about yourself and others and communicate with others. Such postings are governed by our Terms of Service. Also, whenever you voluntarily disclose personal information on publicly-viewable pages, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information.

7. LINKS TO OTHER WEBSITES OR SERVICES

This Service may contain links to other websites or services not operated or controlled by Eden. The policies and procedures we describe here do not apply to these third party sites, nor do the links from this Service imply that Eden endorses or has reviewed these third party sites. We suggest contacting those sites directly for information on their privacy policies.

8. STEPS WE TAKE TO PROTECT YOUR PRIVACY

Eden takes reasonable steps to protect the Personal Information provided via the Service from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet, email or other electronic transmission is ever fully secure or error free, so you should take special care in deciding what information you send to us in this way.

9. CHANGES TO OUR PRIVACY POLICY

Although most changes are likely to be minor, Eden may change its Privacy Policy from time to time. When we do, we will let you know by changing the “Last Updated” date within this Privacy Policy, and your continued use of the Service shall indicate your agreement with the terms of the revised Privacy Policy.
